Postsecondary institutions in Florida, as elsewhere, are increasingly looking for ways to help students cover the cost of enrollment and to supplement Title IV funding with private loans and billing plans, for various reasons, including 90/10 compliance.  As required by the Higher Education Opportunity Act of 2008, the Federal Reserve Board recently amended its regulations that implement the Truth in Lending Act known as “Regulation Z.”  Those changes address specific requirements of private education loans, including institutional billing plans.  Institutions and outside lenders that offer any kind of private credit to students for educational expenses need to be aware of these changes.

Presenter Information:

Jason S. McCarter is an attorney in the Litigation practice at Dow Lohnes PLLC, where he represents clients in a variety of complex commercial disputes involving contracts, business torts, creditors' rights, secured transactions, telecommunications services, and real estate.  Jason routinely counsels merchants, lenders, and educators on Uniform Commercial Code, federal lending regulations, and privacy issues.  Jason is a member of the National Association of College and University Attorneys and the Career College Association.

Aaron D. Lacey is an attorney in the Postsecondary Education practice at Dow Lohnes PLLC, where he counsels institutions of higher education regarding compliance with a broad array of federal, state, and accrediting agency regulations.  Aaron works extensively with institutions on matters involving educational financing.  Aaron is a member of the National Association of Financial Aid Administrators, the National Association of College and University Attorneys, and the Career College Association.
